PLEASE READ THE FOLLOWING PRIVACY POLICY CAREFULLY BEFORE PARTICIPATING IN THIS application KNOWN AS "RRP". BY PARTICIPATING WITH THE RRP, YOU AGREE TO BE LEGALLY BOUND BY THESE PRIVACY POLICY ("PRIVACY POLICY"). IF YOU DO NOT AGREE TO THESE PRIVACY POLICY, PLEASE DO NOT PARTICIPATE IN THE RRP.

We do not take any sensitive or personal data of the user in our database.

PRIVACY POLICY:

1. " RRP " is conceptualized, organized and hosted by Corporate Incentive Solutions Private Limited, a company incorporated under the Companies Act, 1956 and having its registered office at SCO 705, Second Floor, NAC, Manimajra, Chandigarh, U.T., Pin 160101, India ( "Corporate Incentive Solutions Pvt. Ltd") and is open for participation by active registered sales person appointed by Retailer Recommendation Program ("RRP") for selling RRP's post-paid category of connection to enterprise subscribers ("Salesman,Retailer") during the period from 07 August 2024 to 31 March 2025 , both days inclusive. Organizer reserves the right to extend or shorten the application Period, as it deems fit.
2. The Auto Pick OTP service is a feature that automatically generates and retrieves one-time passwords (OTP) for user authentication purposes. It is designed to enhance security and streamline the login process for users. It does not belong to anyone else, nor do we store this data with ourselves.
3. The location permission is mandatory for the user to allow as this the core functionality of the app as the user needs to capture the location while registering the shop so that no fraud occurs as one shop is being enrolled multiple times and getting incentivized.
4. The application is open for all active Salespersons who meet the eligibility criteria mentioned in Clause 3 below and who belong to the following RRP circles ("Circle(s)") as mentioned in table below.
5. Notwithstanding the foregoing, if the operation of or participation in the application is prohibited in any State and/or territory or part thereof as per applicable law, the Salesperson from such State and/or territory or part thereof shall not be eligible to participate in the application. No further notice shall be given by the Organizer or RRP, in this regard.
6. Eligibility

This application is open for participation for all Salesman/Retailers who fulfil the following criteria:

• He/she must be of or above 18 years of age;
• He/she must be a resident of India;
• He/she must belong to any one of the Circles mentioned herein;
• He/she must be an active Channel Partner Promoter;
• He/she must not have been the subject of any criminal proceeding;
• He/she must not be of an unsound mind; and
• He/she must not be under any legal disability e.g., insolvency, restraint by court order etc. and / or is prohibited from entering any contractual relationship.
• This application is open to all RRP active Channel Partner Promoters. Any active Channel Partner Promoter participating in this application shall be referred to as a "Participant" throughout these PRIVACY POLICY.
• For the purposes of these PRIVACY POLICY, wherever the context so requires "You" or "Your" shall mean any natural person who is a Participant.

Also, by participating in this application, You:

• Agree to the PRIVACY POLICY mentioned below and give Your consent for the same;
• Agree that You are entering into this application as an independent party and nothing herein establishes an employer-employee relationship between You and RRP or between You and Organizer and You are acting voluntarily, using Your own time and resources to participate in this application, solely at Your own risk;
• Warrant that You have read understood and agreed to conform to these PRIVACY POLICY;
• Warrant the accuracy, truthfulness and currency of all information that You have submitted; and
• Warrant that prior to participating in this application, it shall be deemed that You have read and have agreed to be bound by the PRIVACY POLICY herein and the PRIVACY POLICY of the RRP.
6. The PRIVACY POLICY are available on the app. The PRIVACY POLICY can be amended or varied from time to time or withdrawn without prior notice to You and therefore, please visit the app to keep Yourself updated and informed.
7. In case of any clarification with regards to this application, please do connect to Organizer's Helpdesk (0172 6605500 from Monday to Friday 10:30 AM to 6:00 PM) or mail your query to support@incentivesoluitions.in and Organizer's Support will revert to You within 4 working hours.
8. All decisions of Organizer in respect of all transactions under this application and other related transactions shall be final and binding and no correspondence or communication shall be entertained in this regard.
9. Any failure on the part of the Participant under this application to comply with directions issued by the Organizer shall entitle the Organizer, at its discretion, to delete the profile.
10. Upon participating in the application, the Channel Partner confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and shall imply their willingness to receive all promotional messages including without limitation daily updates on the score under the current application and engagement calls / SMS, promoting the new application. Such interest & the subscription for the will be valid for all upcoming application done jointly by Organizer and RRP.
11. Organizer, RRP or their respective affiliates shall be entitled to use, in any manner, the details of the Participants or application information's including the Information i.e. name, photograph, RRP mobile number, address etc. for their sales, marketing and promotional purposes, including the gifts/prizes awarded to them, if any. By participating in the application, all Participants hereby agree to the same. Organizer may, at its discretion, choose not to disclose the identity of the selected Participant to other Participants, unless otherwise mentioned herein.
12. The Organizer is not collecting any sensitive data. We collect only mandatory field i.e; user mobile number against the participant for application login. The hence captured only data is also deletable whenever required.
13. None of the information is henceforth shared with any 3rd party and is highly encrypted.
14. By participating in the application, Participants consent to the following information relating to them to be exchanged between RRP, Organizer and their concerned vendors and/or published or otherwise communicated to in any media that the Organizer may deem fit, for the purpose of announcement: name, mobile phone number, score and/or photograph. The Participants also consent to the information being shared by Organizer with its affiliates and service providers and to the information being processed and stored in the servers of Organizer or its service providers.
15. Subject to any applicable law (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly DISCLAIMED by the Organizer and RRP including, but not limited to, meeting of the Participant's requirements or aspirations, timeliness, security, the results or reliability of this application, or the delivery, quality, quantity, merchantability of the gifts or non-infringement in respect of any goods, services, benefits or awards acquired or obtained through the application or any transactions effected through the application; (b) The Participant expressly agrees that his/her participation in the application offered by the Organizer is at the Participant 's sole risk and is governed by the PRIVACY POLICY herein; and (c) No advice or information whether by representations, oral, written or pictorial derived from the application, website or through the application shall be construed to mean the giving of any warranty of any kind by the Organizer or RRP.
16. This application is subject to guidelines and directions issued by the Department of Telecommunications ("DoT"), Telecom Regulatory Authority of India ("TRAI") or any other statutory authority from time to time.
17. RRP and the Organizer shall not be responsible for any claims arising out of technical failures before, during or after the completion of the application including but not limited to any technical failures in recording the point on the application, any action that has been initiated, actioned or completed through the Participants or the failure to provide the correct application score updates or any mistakes arising out of technical snags or resultant inability of the listener for participation. Further, the Organizer and/or RRP shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of RRP or the Organizer.
18. Failure by the Organizer to enforce any of the PRIVACY POLICY in any instance shall not be deemed to be a waiver of that Term and Condition and shall not give rise to any claim by any person. The decision of the Organizer shall at all times be binding and final.
19. RRP and/or the Organizer reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer/ application or any part thereof including the eligibility criteria, the PRIVACY POLICY at its sole discretion at any time as may be required including in view of business exigencies, authorities, changes by regulatory authority and/or statutory changes and for other reasons beyond its control. The latest revised version of the PRIVACY POLICY shall be effective and binding on the Participants from the time of its posting on the app, website. You are therefore advised to check the app, website regularly for any update(s) or amendment(s) made to these PRIVACY POLICY and in the event the modified or amended PRIVACY POLICY are not acceptable to You, you should discontinue from participating from the application. Your continued participation to application there under will constitute your acceptance of the latest revised PRIVACY POLICY.
20. The employees of the Organizer and of their group companies, affiliate or associate companies and their relatives/ dependents shall not be eligible to participate in this challenge. If found otherwise, then Organizer reserves the right to forfeit their services.
21. The Organizer and/or RRP reserve the right, at any time, to unconditionally disqualify any Participant who tampers with or who in any way abuses the process or PRIVACY POLICY of the application. Failure by Organizer or RRP to enforce any of its rights at any stage does not constitute a waiver of those rights and shall not give rise to any claim by any person.
22. Any attempt by a Participant to deliberately undermine the legitimate operation of the application is a violation of the applicable laws and should such an attempt be made, the Organizer and/or RRP reserve the right to seek damages from any such Participant to the fullest extent permitted by law.
23. Organizer and RRP do not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the Participant.
24. Organizer's and RRP's officials including their respective directors, officers, partners, employees, representatives, consultants and agents are under no obligation to render any advice or service to any Participant in respect of the application.
25. You acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the Yodha app content and all material or content related to the application shall remain, at all times, owned by RRP and their respective owners. All material and content contained in this app, Website is made available for your personal and non-commercial use only. Any other use of the material/ content on this app, Website and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.
26. The Channel Partner shall indemnify and keep indemnified RRP and Organizer and their officers, directors, employees, customers, affiliates and agents harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which Organizer or RRP may incur, pay or become responsible for as a result of breach or alleged breach of the representations or obligations of the Channel Partner FOS under the PRIVACY POLICY , any failure by the Channel Partner FOS participating in this application to comply with applicable law and any third party claim in respect of misuse of any information of a third party. RRP and Organizer shall have the right to defend themselves, pursuant to this Clause, at the cost of the Channel Partner. The Organizer, RRP or their respective affiliates shall not be responsible for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the Participant, in connection with the application.
27. Nothing in the application shall affect any intellectual property rights of RRP or the Organizer or any of their affiliates in any product or service made available on the Website.
28. The application data does not belong to anyone else, nor do we store this data with ourselves. Also, we have kept the data in encrypted format and data gets auto deleted time to time.
